What is the federal False Claims Act?

The federal False Claims Act (FCA), 31 U.S.C. §§ 3729 - 3733 permits a whistleblower to file a qui tam lawsuit against a defendant for defrauding the Utah Medicaid Program and rewards the whistleblower with a percentage of the damages recovered. The term qui tam refers to a Latin phrase, meaning that the person sues on behalf of himself or herself and the Government. The Federal False Claims Act are filed in secret “Under Seal” to allow an investigation based on the whistleblower’s information.
